Types Of Divorce

You can only apply for a divorce after you have been married for at least twelve months (two years in Northern Ireland). There are no exceptions to this rule. To get divorced, your marriage must be recognised as valid by United Kingdom law.

Divorce proceedings can be initiated by either spouse filing a divorce petition. The partner who initiates the divorce is referred to as the Petitioner, while the remaining partner is referred to as the Respondent.

If both partners agree to the divorce, it is an undefended divorce. If one of you does not agree to the divorce, it is a defended divorce.
